Ricafrica provides an online marketplace for a variety of African itmes as we define them. Items listed for sale on Ricafrica are not sold directly by Ricafrica. Rather, Ricafrica is a website through which buyers can find, learn about and purchase African items from sellers around the world.
Ricafrica.com LLC, hereon referred to as Ricafrica, has established policies to create positive and uplifting experiences for buyers, sellers and visitors alike. We refer to these policies as our terms and conditions or T&Cs. All users and visitors of Ricafrica should familiarize themselves with our T&Cs. Make sure you read, understand, and regularly check our T&Cs as they may change. You will become bound by these provisions once you accept these Terms and Conditions. By clicking “sign in” and entering or otherwise using the Ricafrica web site or mobile applications (the “Web site”), you agree to and accept these Terms and Conditions. Signing up for an Account:
In order to use certain features of the Web site (e.g., listing, selling or purchasing products and services (referred to collectively as “Products” herein) from the Web site), you must register for an account with Ricafrica (“Ricafrica Account”) and provide certain information about yourself as prompted by the Web site registration form. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the Web site does not violate any applicable law or regulation or the terms of this Agreement. You may de-activate your Ricafrica Account at any time, for any reason, by unchecking the e-mail preference box on the “My Account” section of the Web site.[KM2] Deactivating your account does not release you of any outstanding obligations including, but not limited to fulfilling orders and completing transactions. Ricafrica may suspend or terminate your Ricafrica Account in accordance with Section 11.
Managing your Ricafrica Account:
You are responsible for maintaining the confidentiality of your Ricafrica Account login information. You are fully responsible for all activities that are associated with your Ricafrica Account (including but not limited to any purchases, listings, sales, use of the Web site, or correspondence from your account to Ricafrica, Ricafrica visitors, and Ricafrica members). You agree to immediately notify Ricafrica of any unauthorized use or suspected unauthorized use of your Ricafrica Account or any other breach of security. When you provide Ricafrica with such notice, Ricafrica will suspend or otherwise secure your Account to prevent future unauthorized activity.
When you use any Ricafrica.com, or send e-mails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. You consent to receive communications from us electronically, such as e-mails, texts, mobile push notices, or notices and messages on this site or through the other Ricafrica platforms, such as our Message Center, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
What can be sold on Ricafrica
Sellers can sell a diverse array of goods on Ricafrica (with exceptions, see section 1.2). All goods must fall into our list of categories. If the item you want to sell does not fall into our list of categories please contact us to request that the item be listed. If approved a new category will be created for your item or we will direct you to the most suitable category for your item.
An item can be listed on Ricafrica if it meets at least one of the following requirements:
- It is designed/developed and made/created by African entrepreneurs or African-owned businesses based on the continent or diaspora.
- The item’s final assembly or processing takes place on the African continent.
- All or virtually all of raw materials or content of the item are from the African continent (only but a negligible amount of the materials or content can be from out of Africa).
Prohibited items on Ricafrica.com
Ricafrica prohibits some items from being listed for various reasons, including but not limited to heavy or ambiguous legal regulations on items, inconsistency with our mission and values, or because they may pose a risk to people, places and things. If you list an item that is prohibited we will take corrective actions, as appropriate, including but not limited to immediately suspending or terminating selling privileges, legal action, including civil and criminal penalties. The following are a list of some of the items and services that are prohibited from being listed on Ricafrica:
- Potentially infringing items may be in violation of certain copyrights, trademarks, or other intellectual property rights e.g. replicas, counterfeit items, and unauthorized copies
- Offensive material, which includes items that are racially or ethnically inappropriate
- Items that promote, support, or glorify hatred
- Prohibited services, which include services that are illegal or sexual in nature or that violate our user agreement
- Animal and animal products
- Used beauty products, personal care items, and food and beverage items. The original packaging and all original content/material for these items should be intact, and there should be no visible signs of wear and tear
- Hazardous Materials, Recalled Items, and Weapons
- Pornography, and obscene and mature content
- Firearms, weapons, knives or items that promote, support, or glorify violence
- Counterfeit coins and paper money such as bank notes, bonds, money orders, silver certificates, and gold certificates
- Stocks and securities
- Equipment designed to create counterfeit items
- Cash or cash equivalent instruments, including money orders, traveler’s checks, stored value products like retail or open loop gift cards, or electronic stored-value redemption codes (except for retail gift cards listed by pre-approved sellers)
- Chance listings that promote giveaways, random drawings, raffles, or prizes
- National treasures and human Remains
- Alcohol, tobacco, drugs, drug paraphernalia, medical drugs and pharmaceuticals
- Vehicles and related equipment and devices
Precious metals, precious stones, or jewels, must comply with United States laws and regulations, 31 C.F.R. Part 1027 and other applicable laws and regulations.
How buying works:
When you purchase a product on Ricafrica, you are not buying directly from Ricafrica, but from an independent seller. Ricafrica is not a part of the transaction. Each seller on Ricafrica has different shop policies, processing times, and shipping methods, which are typically noted in listing descriptions. Sellers must abide by Ricafrica’s terms and conditions, however, Ricafrica does not pre-screen sellers and does not guarantee or endorse any items sold on Ricafrica or any content posted by sellers. Buyers and visitors to Ricafrica.com can, however, confidentially notify Ricafrica if a seller violates Ricafrica terms and conditions.
Purchasing Items on Ricafrica:
When you buy an item on Ricafrica you are directly transacting with an independent individual or business, each with its unique listings, policies, processing times, and payment systems. By making a purchase from a seller on Ricafrica, you agree that you:
- Have read the item description and shop policies before making a purchase;
- Have submitted appropriate payment for item(s) purchased; and
- Have provided accurate shipping information to the sellers of each item purchased.
Resolving Problems with Orders:
In the event that your purchase from a seller does not go as expected, you must attempt to resolve the issue/s with the seller directly through the message board.
If you’ve reached out to the seller and haven’t heard back, or if you’re unable to resolve your issue together, you can file what’s known as a “case.”
Buyers can cancel a transaction within 24 hours of purchasing the item/s or before the item/s have shipped (whichever comes first), even if they already paid for the purchase.
After 24 hours, buyers may request that a seller cancel an order via the Messageboard because, only sellers can cancel transactions 24 hours after the purchase. The seller has 72 hours to approve or decline the request. If the item has already shipped when a buyer requests to cancel a transaction, return policies apply.
Each seller has his or her own return policies, which should be outlined in each listing. Not all sellers accept returns. If you reside in the European Union, you may be entitled to a 14-day “cooling off period,” or a “right of withdrawal,” during which you may return an item for any reason. When an item is returned, to refund the buyer, the seller authorizes Ricafrica to request that PayPal remove the refund amount (in same or other currency) from your PayPal account, place the amount on your invoice, and/or charge your payment method on file.
